These Terms of Service ("Terms") govern your access to and use of velacams.com ("VelaCams," "the Site," "we," "us," or "our"). By accessing or using VelaCams, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
1. Age Requirement
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, to access VelaCams. By using this Site, you represent and warrant that you meet this age requirement. VelaCams is an adult-oriented website, and access by minors is strictly prohibited.
If we have reason to believe that a user does not meet the age requirement, we reserve the right to immediately terminate access without notice.
2. Service Description
VelaCams is an aggregator that indexes publicly available performer listings from third-party webcam platforms. We do not host, produce, store, or distribute any video content, streams, or media. All streams and performer content are served directly by their respective third-party platforms.
VelaCams does not operate as a webcam platform itself. We provide a directory and discovery service that helps users find performers across multiple platforms. We do not control performer availability, stream quality, pricing, or any aspect of the third-party platforms we index.
3. Acceptable Use
When using VelaCams, you agree not to:
- Use automated tools, bots, scrapers, or crawlers to access, extract, or index content from the Site without our prior written consent.
- Attempt to circumvent any access restrictions, rate limits, or security measures implemented on the Site.
- Reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Site for commercial purposes without our express written permission.
- Interfere with or disrupt the Site's infrastructure, servers, or networks.
- Use the Site for any unlawful purpose or in violation of any applicable local, national, or international law.
- Impersonate VelaCams, its operators, or any other person or entity.
- Attempt to reverse engineer, decompile, or disassemble any part of the Site's software or systems.
4. Affiliate Disclosure
VelaCams participates in affiliate programs with third-party webcam platforms including Chaturbate, BongaCams, Stripchat, LiveJasmin, CamSoda, CAM4, Streamate, Flirt4Free, XLoveCam, and SkyPrivate. Links to these platforms contain affiliate tracking parameters, and VelaCams may earn a commission when you visit or transact on these platforms through our links.
Affiliate relationships do not affect the order, prominence, or availability of performer listings on VelaCams. Commissions are paid by the platforms, not by you, and your experience on the destination platform is not altered by arriving through an affiliate link.
5. Intellectual Property
The VelaCams name, logo, site design, layout, and original code are the intellectual property of VelaCams and are protected by applicable intellectual property laws. You may not use our branding, trademarks, or design elements without our prior written consent.
All performer images, thumbnails, stream content, usernames, and profile information displayed on VelaCams are the property of their respective platforms and performers. VelaCams claims no ownership over third-party content and displays it under the terms of each platform's affiliate or API program.
6. No Warranties
VelaCams is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Performer availability, stream quality, platform uptime, and pricing are controlled entirely by third-party services and are beyond our control. We make no guarantees regarding the accuracy, completeness, or timeliness of the performer listings displayed.
7. Limitation of Liability
To the fullest extent permitted by applicable law, VelaCams and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses.
Our total aggregate liability for any claims arising from your use of VelaCams shall not exceed the amount you paid to us in the twelve months preceding the claim, which in all cases is zero, as VelaCams is a free service.
This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless VelaCams and its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
9. Third-Party Links and Platforms
VelaCams contains links to third-party webcam platforms and other external websites. These links are provided for your convenience and do not signify our endorsement of those sites or their content. We have no control over the content, privacy practices, or availability of third-party platforms.
Your interactions with third-party platforms, including any purchases, account creation, or data you provide to them, are solely between you and that platform. VelaCams is not responsible for any damages or losses incurred as a result of your dealings with third-party platforms accessed through our Site.
10. Termination
We reserve the right to restrict, suspend, or terminate your access to VelaCams at any time, for any reason, without prior notice or liability. Reasons for termination may include, but are not limited to, violations of these Terms, abusive behavior, automated access, or any activity that we determine to be harmful to the Site or its users.
Upon termination, all provisions of these Terms which by their nature should survive will remain in effect, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VelaCams operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the competent courts of that jurisdiction.
12. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy and 2257 Compliance Statement, constitute the entire agreement between you and VelaCams regarding your use of the Site. These Terms supersede any prior agreements or understandings, whether written or oral.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of VelaCams after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
